Hydraulic Fracturing: Selected Legal Issues

This CRS report introduces the practice of using hydraulic fracturing to obtain oil and natural gas, and discusses the details of its legality and the legal issues surrounding the practice. The report goes over the regulations imposed on fracturing by federal laws such as the Safe Drinking Water Act, as well the influence of local zoning laws and authorities on fracturing, state tort laws, as well as developing legislation in Congress. Additionally, the issues raised by environmental groups about fracturing, as well as legal developments regarding the role of regulation on fracturing are also discussed.
